does any normal american know one person who got charged with a crime and then was permitted to appeal BEFORE the conviction? i dealt with convicted criminals for years in my work, and never saw anyone get a single PRETRIAL appeal.

Umm, what did you think the judge should have done? If he brushed it all under the rug, they would have brought it up on appeal. Judges make decisions, that's what they do. If you don't want to suffer from adverse decisions, then avoid trials.

Your teacher was right. Speech intended to cause a panic is no protected by the 1st Amendment. Whether it is a crime depends on whether there was actually a fire and whether the person who yelled intended to create a panic.
