unfortunately thats not how the law works, its up to the judge to decide if its fair use or not and a lot of people dont have the thousands of dollars it takes to sue

There are four guidelines judges use concerning proper application of the fair use standard in copyright violations. While Mr. Gonzalez can argue his commentary might be transformative, the studio could argue that it affected their market value and that he violated their material in the amount and substantial portion he used. His video essentially discussed the entire plot, making it so that viewers would need or want to go purchase the film. KRplus would certainly agree with studios who advertise with them in order to maintain their funding relationship. Since this was a small studio and an older film, the case was not taken as seriously, but don't be surprised to see more studios unite and challenge fair use. No one is questioning commentary and free speech, but it's the embedding of someone else's work that is in clear violation.

Measuring Fair Use: The Four Factors
Unfortunately, the only way to get a definitive answer on whether a particular use is a fair use is to have it resolved in federal court. Judges use four factors to resolve fair use disputes, as discussed in detail below. It’s important to understand that these factors are only guidelines that courts are free to adapt to particular situations on a case‑by‑case basis. In other words, a judge has a great deal of freedom when making a fair use determination, so the outcome in any given case can be hard to predict.
The four factors judges consider are:
the purpose and character of your use
the nature of the copyrighted work
the amount and substantiality of the portion taken, and
the effect of the use upon the potential market.

The reason legal options is getting them to back off is because it’s not worth their time and money to go to court about it. They basically want you to take it down but if they think you’ll take them to court, it instantly becomes not worth it. Eventually, a big company may call your bluff though.

the 'reviewing legal options' thing works because these studios and brands know they're in the wrong but 90% of people won't bother going through the complicated and obtuse steps of combating it in any way, so they are pretty much able to do whatever they want without consequences. its better not to risk getting actually sued and instead copyright fair videos from 10 other channels that wont or cant do anything about it
