NO - what the man was saying is that several states went around their state legislatures - THE legal bodies within their respective states who were supposed to set election law in their respective states. That did not happen in those states! They went against their state constitutions - the assertion being when their election boards acted in an unconstitutional manner - it sullied the votes of those states that acted within THEIR state's Constitutionally legal election laws. Judges who were asked to rule on the issue were spineless; they saw the left's reaction to the election of 2000 - and Obama's general hostile reaction and direct assertions made to the Justices seated during his SOTU speech. Obama is famous - or infamous when it comes to respecting the American political way of life and government. Jordan is a good decent man. He gets my vote! Regarding your response:
Texas argued that the states violated the Constitution's Electors Clause because said states made changes to voting rules and procedures through courts or executive actions, but not through their state legislatures. (In other words, by sidestepping or doing an end-around the required state legislatures). The Constitution calls explicitly for the legislatures of the states as the single source of election law. A copy of the clause follows:
Clause 2. Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress; but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.
The LEGISLATURES of the State, NOT the courts, NOT the governors, and SURELY NOT a bunch of unelected, hack bureaucrats - regardless of party! It seems there IS a central authority - albeit one far removed from the fifty individual states - AND their election boards - yet powerful enough to hold them all to account.
There are many opinions as to why they ruled as they did, my opinion, at least a couple follow:
I am confident that local judges did not want to shoulder the responsibility of such a decision - at least in part for fear of attracting the ire of those who would disagree with it.
The High Court justices - who ultimately decided that Texas "had no standing," suggesting that other states could not bring such a lawsuit since they have no legal say in other states' internal affairs. This, even though the actions of the states in question affect the outcome of a national election.
Investigations take time, I believe evidence will come to the fore; although not in time to make any sort of change in the outcome of the election.
Just my opinion. The fact that those states DID act against the US Constitution's precepts means that citizens of each State could bring the same lawsuit.
