Hey guys. I've thought about doing a video about this for a long time. Over the years of doing Game Theory, people have had one MAJOR problem with the series - the use of fanart. And since I'm covering the Scott Fan Art Issue as well, I figured what better day than today to address it. I've done my best to set rules in place to keep fanart out of Game Theory but accidents happen and things slip through the cracks. Today I am setting the record straight on Game Theory and fanart. Plus, hopefully giving you fan artists some advice on how to keep your fanart from being stolen.

It’s just the kind of person he is. He cares. And when things go wrong for others he feels like it’s his fault. That part isn’t great but he does it because he doesn’t want people he cares about to be hurt(he cares about everyone).
I don't think this is Mat Pat's fault at all. I think people that complain about stealing their fan art are major hypocrits. Also I consider Game Theory and Film Theory too be fair use. So Mat Pat should be allowed to use other people's work in the way that he does. He is not the problem.
as an artist, i’m not mad about this. if your art looks very similar to the original, you’re bound to have people mistake the two. you can’t get upset you’re not getting credit if you make it very similar to the original.
the artist is 100% in the right for asking for credit, but being upset over an accident? that’s not cool
the biggest thing in art stealing controversies is intent. why did they steal it? was it on purpose? was it to profit off of the image? pretend like it’s their own?
when your art is similar to the original, you really can’t be upset at people for mistaking it as such. informing and asking for credit is what you should do, but trying to cancel someone over an accident that isn’t hard to do is not

I mean it makes sense. His “theories” make no sense half the time. His jokes are the worst dad jokes you could possibly imagine. The intros to his videos are cringy and unfunny. And he even sometimes makes up numbers. I remember when I was watching matpats Ridley smash bros video and my friend pulled out a calculator and did the same calculations that matpat did and ended up with a different number. I don’t remember what it was but he definitely makes up numbers. Don’t get me wrong, I’m still a huge fan of his videos. But I still see and understand why he gets hate

As an artist I really respect MatPat for this, he explained the situation and I am not mad at him (not in the slightest). I mean how could I, how could anyone ? they were just some honest mistakes. They never even wanted this to happen. Game theory even makes a video about it to spread the awareness, I am actually really grateful to people like him having so much respect for arists and actually caring about stuff like this ! I hope he doesn't feel too bad about it, he really shouldn't.

I would even hesitate to say that Matpat made a mistake here. He had full faith and confidence that the images he used were official; since they weren't marked or signed in any way, and were so well-made that even the creator of the thing the fanart was emulating had trouble telling them from his own work.
I would place the majority of the blame on the artist themselves in this situation. They failed to learn one of the most basic things school teaches you right from the first day: "If you want credit, put your name on it".
And yes, there are assholes out there that remove obvious distinguishing marks from fanart. However, artists have to be smart about how they mark their art. To catch illegal copiers, mapmakers would often include a fake street named after themselves hidden in their maps. That way, if they ever came upon another map with that street, they knew there was some tomfoolery going on. Creativity doesn't just make art, it can also protect it.

Hi!! If anyone doesn't know, Adobe 2018 and up have settings where you can claim your files to be copyrighted or not. Therefore, when it's uploaded, it'll never be used as commercial reuse.
As a fellow artist (if you can even call my trashy sketches that lmao) I agree 100% with you. I always make sure to put my insta @ right over the art to prevent people from stealing (though I’m not sure why someone would really wanna steal my trash but y’know, you can never be too careful). And on top of this? I would actually be over the moon excited if my art somehow got featured on possibly my absolute favorite channel on KRplus! I mean, that would have to mean my art is good enough to be mistaken as real.

Copyright law: No, it's not.
@@DoomGuyBFG Depends on which copyright law it is. - Some US copyright laws in the past has at least stated that if you don't sign it, it isn't copyrighted. But that isn't modern copyright law, at least not in some countries. If you create something, even unsigned, it's yours.
And this whole comment (reply’s included) shows the problems with the higher ups and how confusing they can be. Because I sure as heck don’t understand them.

MatPat I'm so glad you posted this video. You're totally right about this issue. People get so mad about you using their fan art, when they don't even try to protect it. You're a human like everyone else, so I can see why you would make that mistake. Also, thanks for the tips on protecting your art. Okay I understand crediting artists because I was an artist at one point but you can’t get mad at people for using your image on accident if you:
1. don’t have a watermark or tag
2. practically traced a majority of the picture.
3. photoshopped your art onto an official design from the originator.

The problem inherently present is people making art of copyrighted ip without permission, and then claiming ownership. If Nintendo wanted, they could go after the artists for even publishing non-authorized art.
Under fair use right, they would not be able to do so. Only if they wanted to make money with it.
Fan art is transformative and under fair use.

Honestly.. from my standpoint, the artist who created the Kirby Star Allies fanart that was shown in this video was kind of at fault for this small mistake. If they don't put their special watermark on it.. it allows other people to mistake the fanart for the genuine box cover.

Being a content creator, especially your kind of content creating, is incredibly difficult. it sucks that you’re put to an unrealistic standard when you’re also human and will make mistakes without meaning to. Hi there, I’ve been a FNAF Fanartist for a year and a half now and have made over 50 FNAF drawings. You have no idea how much it means to me that you addressed this, because many people think that artists are always being too stubborn about people using their artwork. It is really incredible to see someone with your amount of influence taking real care with fan art, because for some of us it is literally our livelihood. Thank you Mat and everyone on the team. :)

It's sad how people resort to the worse option that GT is doing it intentionally and not just saying "oh hey! My fan art! You can find me at (insert plug)". Damn the internet has gotten jaded.
I think in the beginning it was the first scenario but then, you begin to deal with art thieves and re-posters who act totally rude to the original artist when confronted and now everyone is on the offensive right out of the gate.
Keep in mind that in the beginning 1) no money was earned on their work, and 2) fandom was a dirty secret that made one an outcast. Now it's everywhere you go artists works are being stolen for profit. There are several "art channels" stealing art videos, putting them into speed paint compilations without saying it isn't their work, letting commentors call them the artist, and monetizing them. So yeah, after spending however long seeing someone they trusted to not do that used their work without asking or crediting, tempers run short.

Gotta love people on twitter searching for a drop of clout before struggling to come to terms with their own insecurities and desperation for validation.
I'm an artist but I always make sure to put my username on my work for traceability. That being said, if something's very obviously fanart but isn't signed, don't use it. The issue is when fanart looks indistinguishable from official art and isn't watermarked so there's no way of figuring out what's going on.

@@cameroncheung8328 Yeah, I remember someone showing me a side-by-side analysis, something about extra pixels on the helmet or whatnot. It was months ago so I forget the exact details, but it was indeed a fanmade sprite.
feelin' slightly less salty if you sit there yourself and look at them side by side you can clearly see literally one pixel that’s different but they 100% used the fanmade sprite instead of their original one. They later changed it to the original in an update.

The fact that Mat noticed the curvature of Bonnie's nose and changed it just to be safe, shows he cares. It shows it is never ever done intentionally, and is never left if there is suspicion that it is fan art. Thanks Mat.

I dont make fan art or any kind of art, but I don’t get how people get mad of people accidentally, or crediting the artist, use their art
For artists getting mad even when credited, it's because the person who took the art is making a monetary profit while the artist is just getting "exposure."
If it's accidental, they may think the person took it on purpose/was too lazy to find the source.
I've gained a new respect for you. Thanks for addressing this, I completely understand how these errors are made and how you're trying to improve them

Dang. See. This is what I like about big name KRplusrs. When they confront big problems that could effect how people view their channels. When KRplusrs personally apologize about these problems makes people realize that even the best of us can make mistakes, and owe up to it
That's not always the case. I've seen some people say that they will 'believe it when they see it' or 'this isn't a real apology', etc etc.
Trust me, I like it too. I really like that a youtuber that is big or small admits to their mistakes. Sadly, depending on the audience they have might not believe them...
I like seeing how much work they actually put into this. It's easy to say "how could they steal someone's work, they should know better." Its another thing when you see that images are doubled checked in drafts, they search for commercial use photos, and not only do they have a way for artists to contact them and let them know if a mistake was made, but they will publicly acknowledge and give credit.
A lot of small youtubers make critical analysis too. Albeit with less credibility because lower subcounts means shitty content.

Not necessarily a tag line but something that I feel a lot of people don't really know how important the small details are. To quote Robert Downey Jr. from "Sherlock Holmes", "...in fact the little details are by far the most important." Bringing those details into light and relaying how they impact the big picture of it all is something not a lot of KRplusrs do and owning up to it just makes us respect you that much more. Completely agree. I think we all need to learn to stop assuming the worst of everything and everyone, and realize that people make mistakes and people can learn from those mistakes. If you don’t forgive anyone for any mistake they ever make, they’ll never change. You have to hear them out and give them a chance to learn first. It’s when someone repeatedly makes the same mistakes without apologizing or trying to fix it that you can get mad. It’s MUCH easier said than done but, I hope most people recognize that giving people a chance to change and improve is important, even if it’s not easy.
If I ever had fanart in a video I would be that person who is like "yo thanks for using my art lol"

Whenever I see some controversy pop up with your name in the title, I'm suspicious from the get go. I've been watching you for a couple of years now (around 2015, I think), I've seen a lot of your videos, A LOT of your streams, and if there is one thing I learned about you and Steph and the crew, is that you're all genuinely good people. You're not mean, you don't exploit us for anything, you take us into consideration when making some decisions (for example, when everyone started using the youtube membership thing, you asked us if we wanted to have that on the channel.), you make quality videos with loads of research and effort put into it, as well as making sure the merch you make is quality as well. Stuff like "matpat steals fanarts" or "matpat isn't citing any work" is an over the top mess people try to pin on you when they don't know the whole story. If there's someting wrong, you fix it and appologize for it (which I feel like you don't need to do half the time because the people who watch you are smart and understanding and the people who go berserk on you for every little thing that goes wrong should go to h-e- double toothpicks 😡). You are great, your team is great, your videos are great, mistakes happen and that's normal, as you said, we're all human and mistakes happen for crying out loud 😧.
