As a former member of an independent Christian band, I experienced this first hand. That's why years later I went to music production school to learn how to do all of the things so that I could build a music production company and hopefully label that can stick a giant middle finger to the mainstream music industry! Can tell you now that courts won't care. It's a private business and there was no contract between the parties, it's not the place of the government to step in on this. Best course of action is to name and shame the data collection company so the public applies pressure on them to change.

The “data collection company” doesn’t really work for Billboard (even if they are getting paid by Billboard). They are working for the record companies, distribution companies, etc. Independent artists are a threat to that business model.

Courts won't care. Private company, no contract between the parties. At best he could try filing a deceptive advertising complaint with the FTC, but as he isn't actually their customer it probably won't have much weight. The most effective course of action would be a social media crusade naming and shaming the company or pressuring Billboard to cut ties with them if they don't change.

I was in the music industry for 20 years as an artist and I can tell you from experience: literally EVERYTHING in the industry benefits empty suits and talentless hacks and screws over the creative class. It's not just as bad as you've heard: it's MUCH worse.

I was a security specialist for several major labels over my career they contracted a company that I had created that took SWAT team Trained officers and ex military including special forces members and integrated them into positions not only to secure individual entertainers but assets for these corporations I seen some extremely shady s*** to the point that they were my largest contract about 60% of my business and I canceled all ties and pulled out of the contract because the things that they were requesting of us and of other contractors and people that worked within their corporations was not only unethical but underhanded and just plain evil. One of these corporations was having us escort literally a ton of art and gold every month and at first it threw me off I couldn't figure out why a music industry corporation would own that much art and gold and then it dawned on me they were using us and that to hide their assets so they didn't have to go into bank accounts.

I’m 7 minutes in and this is interesting, but I want to know which data collection agency you were in contact with. I report physical sales to billboard independently every album and initially I had to give them access to the website’s backend, which I did. They’ve never asked about publishing or anything of that nature. They did count the physical sales though, which were in the thousands. I’m sure I can help.

As an ecommerce guy, let me explain why logging into store backend should provide verification of Tom's numbers... Every transaction will have a transaction ID along with payment verification from the credit card processor....this cannot be faked or scammed in on the backend. Billboard clearly does not want to accept information Tom & crew.

The problem is that Tom and other independent artists would be able to make even more sales (music as well as merchandise) if the billboards would report accurate information without bias against independent artists. I don't think it was validation at all. It was to get their message out to the entire world. By putting your name on the chart, you're getting people to look you up and see your message. The validation comes as a cherry on top.
Billboard should be bombard with emails highlighting this issue so that Billboard considers going with a different data collection agency in order to not have their reputation be tarnished any further.
Definitely this should be made public through any willing media outlet.
Billboard will then need to address the situation and give new guidelines to the media collection company.
This sounds like a great way to encourage a genuine solution. Are there other things we can do - nonviolent of course - that will cause a correction of this..."issue"?

Tell Billboard how fake their rankings are because they get fake data. If that becomes common knowledge, they might actually take issue with their data collection agency.

This leads me to believe that Industries like music for instance have been lying about numbers forever. They prop up artists that they create themselves, then they create a fake buzz around the artist and fake numbers. This leaves out independent creators like Tom and Nova. I hope you guys get the attention you deserve.

Rolling out an independent capable of numbers even remotely on the same level as huge publishers would cripple them over night. Musicians believe they have to sign to ever have a chance to be noticed. This proves that fact is nothing but a myth. Only solution is scream fake and bury it to protect their own worth.
As far as the independent data collector, this is nothing but a gate keeper. They don't put the time and money into collecting data for free. Someone is paying them, and they pay very well. Wouldn't want to lose that.
There is no competition, there isn't some other agency you can go through. They are totally protected. There is no way to out compete them because the wallet would never see them as legitimate. It would ruin them to allow a second source out of their control collecting any type of data. It might prove their own cash printers to be less popular than the independents. This would just result in a landslide from those who just follow whoever is most popular.
This fight will be huge. It will take someone on the inside flipping. Maybe some hero will speak up. Otherwise it will take an army of independents. Tom might just be the pied piper.

I can explain the abnormally high sales: the music industry is selling manure disguised as music while independent artists are the only ones releasing quality songs.
