I wonder tho, the game being that popular wouldnโt it hurt them more to sue than just let it be. Look at it this way, you got someone that made a game essentially taking a lot of inspiration from your game by taking the basic context but making creative decisions that make it a very well made and very well loved game. On the other hand youโve been coughing out the same game for over 15 years. Like copy and paste not a single improvement, no the same buggy shitty game you just change a few Pokรฉmonโs give them some new bs names and call it a day because you know braindeads will still buy it so why would you put in an effort and make something good. But now someone else did it for you, answered the prayers of your entire player base and finally gave them something they want and that they enjoy. And cheaper too, itโs a feeling they had forgotten in this modern video game era, long gone are the days you get to pay a reasonable price for a good game that has some heart out into it. So now if you sue itโs going to be very public and the millions that like that game are not going to like you for trying to shut down the one things theyโve been asking you for but you never provided. You see where Iโm going with this. Youโd stand to lose more by suing than by not suing. Honestly I used to love Pokรฉmon as a kid until paying $60 for the same game reskinned got old pretty quick as I got older.

The funniest part about this all is that the game is still in Early Access and has years upon years of updates coming. Weโve only scratched the surface of the game even if we have hit lvl 50 and bred the perfect Pal Team.
In alpha most of the modeling is basically complete, granted for some of the more egregious pals. A slight edit can be made to further distinguish the eevees from the Cremises if it really may be an issue. Otherwise they look different enough to say they are different art wise.

I think the fact that Nintendo, a company notorious for snuffing out fan made games or spinoffs before they even see the light of day, didnโt shut down Palworld when it was in production is a good indicator that they (probably) wonโt sue.
Nintendo has known about Palword for 3 years. They're the most litigious company i know of. They both are centered in Japan so they wouldn't even have deal with international law. Japan DOES NOT have a fair use clause.
Palworld is out, and the pokemon mod got DMCA'd before it even got released. Nintendo has no issue with Palworld itself, despite what armchair lawyers on twitter might say.

American laws are weird for other countries because we require active litigation to maintain trademark and copyright, so you aren't allowed to tolerate any infringement... except for satire and parody, which is super protected here and not in Japan.

Actually Nintendo can't win the lawsuit against Palworld because while they own the Pokemon they don't own the concept of a creature that you capture, or the concept for any design of the pokemons (example: Nintendo owns Pikachu, but doesn't own the concept of an electric rat) so as long as Palworld doesn't straight up copy a pokemon Nintendo has no power whatsoever
