I think he got permission for that. With the release of the documentary, Toby's failures as an HR Rep were made clear to David Wallace, and he probably agreed to let Dwight fire him
I'd like to think that it's because of the way the company was structured while Michael was there. When he was there, there was corporate and then Sabre that have management over him. Dwight was directly under David Wallace and no one else, which pretty much gave him more authority than Michael ever had.
When Michael asked David if he could fire Toby, he said, "not without cause". Michael said, "be-cause I hate him". David said no...not "you don't have authority"
